Human Resources and Emiratisation Organizes an Awareness-raising Workshop on Domestic Labour Law and its Implementing Regulations

The Ministry of Human Resources and Emiratisation (MOHRE) organized a workshop to raise awareness among the owners of recruitment agencies regarding the Domestic Labour Law and its implementation regulations.

Ahmed Al-Hosani, Head of the Inspection Division at the Guidance and Follow-up Department for Domestic Workers, reviewed all the rights and duties stipulated by the Domestic Labour Law, whether for employers, recruitment agencies or domestic workers, during the workshop held lately in the Ministry Headquarters in Dubai.

Al-Hosani discussed the probation period which a domestic worker undergoes and the employer’s rights during that period, in which s/he can recover the recruitment costs or replace one worker with another, in view of his/her wish. This applies in four cases, including: the unlawful termination of the contract by a domestic worker, leaving the job without an acceptable reason, the worker’s lack of medical fitness or the worker’s inability to perform his duties as required and agreed upon.

Al-Hosani pointed out that the regulations of the Law have extended the period of insurance on a domestic worker until the end of the contract, thereby obliging the recruitment agencies to repay part of the recruitment costs to the employer in two cases during the post-probation period and until the end of the contract.

The two cases referred to above include the unlawful termination of the contract after the probation period by a domestic worker or leaving his job after the probation period without an acceptable cause. The amounts recovered by the employer shall then be calculated according to the remaining period of the contract in months, out of the total recruitment cost.

Al-Hosani emphasized that the Domestic Labour Law and its implementing regulations have ensured numerous privileges for the parties to the contractual relationship.
