Public Consultation on the Obligations of Recruitment Offices and the Rights of the Employer


The Ministry of Human Resources and Emiratisation has launched a new legal system regarding support service workers. The system aims to enhance and regulate the employment relationship with support service workers in the UAE, to define the responsibilities of the parties involved, to preserve their rights and obligations in a balanced manner, and to ensure the provision of a suitable work environment for support service workers in accordance with the legislation and international agreements applicable in the country. This will strengthen the UAE's global leadership as a preferred destination for living and working.

 The Ministry introduced the comprehensive legal framework into effect on December 15th, 2022, to ensure that the contracting parties fulfill their obligations and to help licensed recruitment offices provide the best services that achieve the comfort, satisfaction, and happiness of employers and citizens and resident families. It also preserves the rights of support service workers and meets the expectations of the contracting parties. This system contributes to reducing labor disputes and enhancing the competitiveness of the UAE. Workers can only be recruited from their home country after informing them of the type of work, nature of the work, and the amount of the wage, as well as   verifying their fitness, health, psychological, and professional conditions, among other specified conditions according to the executive regulations of the decree and other decisions issued by the Ministry.

Recruitment offices, directly or indirectly, are prohibited from accepting commissions in exchange for the worker's employment or paying any fees. The decree requires recruitment offices to treat support service workers well and educate them on UAE customs and traditions, and inform them of the authorities concerned with complaints about any infringement of their rights and freedoms. The system also ensures the provision of appropriate housing and meals for support service workers in compliance with the rules and regulations governing workers' housing in the country. Recruitment offices bear the expenses of returning the support service worker to their home country, providing a replacement, or refunding the amounts paid to the employer, in accordance with the Ministry's decisions


The purpose of this consultation is to monitor the opinions and feedback of clients regarding their awareness of the legal points that ensure the fulfillment of the contractual obligations of both parties, and to assist recruitment agencies in providing the best services, and to ensure the employer's rights to demand compensation from the recruitment agency for any damages that may result from a breach of the contract

The development of the Ministry of Human Resources and Emiratisation's awareness system on the comprehensive legal framework for the obligations of the contracting parties aims to assist recruitment offices in providing better services, ensure the rights of the employer to demand compensation from the recruitment office for any damages resulting from a breach of the contract, and work on enhancing its implementation based on the opinions of the stakeholders
